REGULATION
on the conduct of one-day sports programs
of the ΝΑΥΤΑΘΛΗΤΙΚΟΣ ΟΜΙΛΟΣ ΜΑΡΙΟΥΠΟΛΙΤΩΝ ΘΕΣΣΑΛΟΝΙΚΗΣ
under the distinctive title “Ν.Ο.ΜΑ.Θ.”

1. General provisions
1.1. This Regulation defines the manner of organization and conduct of the one-day sports programs (hereinafter: the “Programs”) implemented by the association under the name “ΝΑΥΤΑΘΛΗΤΙΚΟΣ ΟΜΙΛΟΣ ΜΑΡΙΟΥΠΟΛΙΤΩΝ ΘΕΣΣΑΛΟΝΙΚΗΣ” and the distinctive title “Ν.Ο.ΜΑ.Θ.” (hereinafter: the “Club”), in accordance with the Club’s Articles of Association and the applicable legislation of Greece.
1.2. The Programs aim at implementing the statutory objectives of the Club, namely the development and promotion of nautical sports activities, rowing in traditional boats, amateur navigation and related sports and recreational activities.
1.3. This Regulation is binding:
– for the members of the Club who participate in the Programs,
– for natural persons who participate in the Programs and are not members of the Club (hereinafter: the “Participants”),
– for the instructors, skippers/captains, crew members and any other person involved.
1.4. Matters not expressly regulated by this Regulation are governed by:
– the Articles of Association of the Club,
– the decisions of the Board of Directors,
– the applicable provisions of the relevant legislation.
1.5. In the event of a conflict between this Regulation and mandatory provisions of the law, the legislative provisions shall prevail and any conflicting provisions of this Regulation shall not apply.
2. Types and structure of the Programs
2.1. The Club organizes the following one-day sports Programs:
“Yal + Yacht + Jeep” (Program “Maximum”),
“Yal + Yacht”,
“Yal + Jeep”,
“Yacht + Jeep”,
“Yal only”,
“Yacht only”,
“Jeep only”.
2.2. The basic and most comprehensive Program is “Yal + Yacht + Jeep” (Program “Maximum”), which includes, in sequence:
(a) a short briefing and presentation of the safety rules,
(b) embarkation of the Participants on the Club’s yal (traditional rowing boat) and rowing under the guidance of an instructor (with the use of a portable engine, if deemed necessary, strictly for safety reasons),
(c) approach of the yal to the pleasure craft (yacht) and safe transfer of the Participants on board,
(d) a sea tour with the yacht along a predetermined route and approach to a port,
(e) embarkation in off-road jeep-type vehicles and routes along predetermined and pre-agreed tracks,
(f) return of the Participants to the base (starting point of the Program).
2.3. The other Programs are shortened versions of the “Maximum” Program, from which the corresponding stage (yal, yacht or jeep) is removed, depending on the title and content of each Program.
2.4. The exact meeting place, starting and finishing time, route, duration of each individual stage, and the composition of the crew and escorting persons are determined by the Club and are communicated in good time to the Participants through an announcement and/or confirmation of participation.
3. Participants in the Programs
3.1. The following have the right to participate in the Programs:
– the members of the Club,
– other natural persons who have reached the required age and accept the terms of participation.
3.2. Persons are accepted who:
– are in sufficient good health to participate in amateur sports and recreational activities,
– do not have medical contraindications to physical exercise, exposure to the sun, presence in water, or travel by waterborne or road vehicles, etc.
3.3. The Participants bear personal responsibility for the truthfulness of their declarations regarding their state of health. In the case of chronic diseases, particular health issues or medication they are taking, the Participant is obliged to inform the Club accordingly before the Program starts.
3.4. The participation of minors is permitted only:
– with written consent of a parent or legal guardian, and
– on condition that they are accompanied by an adult or responsible person appointed by the Club, in accordance with a separately defined procedure.
3.5. Each Participant who is not a member of the Club is required, as a precondition for participation, to sign:
– a “Declaration of participation in a sports program”, and
– where necessary, supplementary documents (information sheet, consent to the processing of personal data, parental consent for minors, etc.), the templates of which are approved by the Board of Directors.
4. Rights and obligations of the Participants
4.1. The Participant has the right:
(a) to be clearly informed about the route, duration, estimated level of physical effort, and the conditions at sea and on land,
(b) to use the equipment and material provided by the Club in accordance with the instructions of the persons in charge,
(c) to withdraw from or discontinue participation, after notifying the persons in charge in advance, subject to the terms of Article 10 of this Regulation.
4.2. The Participant is obliged:
(a) to carefully attend the safety briefing,
(b) to comply with the orders and instructions of the skipper/captain, the instructors and the escorts,
(c) to maintain order and not to create dangerous situations for themselves or third parties,
(d) not to be under the influence of alcohol, drugs or psychoactive substances,
(e) not to smoke and not to consume alcohol on board the vessel or the vehicles, unless this is expressly permitted by the persons in charge in safe places and at an appropriate time,
(f) to use a life jacket and other safety equipment when this is required or indicated by the Club or the skipper,
(g) to respect the general rules of conduct in the water, on board the vessel and inside the vehicles.
4.3. The Participant is prohibited:
– from arbitrarily leaving the vessel, vehicle or group,
– from diving, jumping into the water or swimming outside the designated locations and times,
– from interfering with the steering of the vessel, the operation of the engines, the helm or the navigation equipment,
– from obstructing the work of the crew and the instructors.
5. Obligations and responsibilities of the Club and the persons in charge
5.1. The Club organizes the Programs and ensures:
(a) the lawful possession and use of the yal and the existence of valid lease/charter agreements for the yacht and the jeep-type vehicles,
(b) the presence of appropriate responsible persons (skipper/captain, instructors, escorts),
(c) the availability of a sufficient number of life jackets and basic safety equipment on board the vessels,
(d) the conduct of a safety briefing before the start of the Program and when moving from one stage to another (yal / yacht / jeep).
5.2. The skipper/captain of the yacht and the lead instructor on the yal have ultimate responsibility for safety issues and may decide, among other things, on:
– modification of the route,
– shortening or cancellation of part of the Program,
– early return to the port or base,
– removal of a Participant from the Program due to serious violation of the rules or obvious signs of intoxication or indisposition.
5.3. The drivers of the jeeps are obliged to comply with the Highway Code, the particularities of off-road driving and the instructions of the Program’s safety coordinator.
5.4. The Club reserves the right:
– to refuse participation to persons who, in the reasonable judgment of the persons in charge, may endanger the safety of themselves or others (e.g. clear intoxication, aggressive behavior, obvious indisposition),
– to modify the program, schedule and route for reasons of safety, weather conditions or technical problems.
6. Equipment and conduct of the Participants
6.1. The Participants must arrive wearing clothing and footwear appropriate to the weather conditions and the type of activity (sea, sun, wind, routes on uneven terrain).
6.2. It is recommended that they bring:
– a hat or other head covering for the sun,
– sun protection (sunscreen),
– light spare clothes,
– drinking water (if not provided in an organized manner).
6.3. The use of personal life jackets is permitted, subject to the approval of the person responsible on behalf of the Club.
6.4. Money, valuables and other personal belongings are kept at the Participant’s own responsibility. The Club is not liable for the loss or damage of personal items, unless there is gross negligence on the part of the persons in charge and provided this is expressly stipulated.
7. Safety rules on the water (Yal and Yacht)
7.1. Before going out to sea, a mandatory briefing is held, which covers, indicatively:
– the method of embarkation and disembarkation,
– the position and permissible movements of the Participants on the vessel,
– the rules for using the oars and life jackets,
– the actions to be taken in case a person falls into the water,
– the appropriate behavior in conditions of waves or sudden changes in weather.
7.2. On the yal and the yacht it is prohibited:
– to run or make sudden movements,
– to move around without permission while underway,
– to sit on the gunwales, rails or the extremities of the vessel,
– to hang one’s legs outside the vessel while it is moving.
7.3. In case of an order given by the skipper or instructor (e.g. “sit down”, “hold on”, “put on life jackets”), the Participants are obliged to comply immediately.
7.4. In the event of deterioration in weather conditions or a technical problem, the skipper decides whether the sea activity will continue, be altered or discontinued. This decision is binding on all Participants.
8. Safety when using the jeeps
8.1. The Participants are obliged:
– to use seat belts where this is technically possible,
– not to lean or climb out of the windows or roof while the vehicle is moving,
– not to distract the driver,
– to follow the instructions of the escorts.
8.2. The following are strictly prohibited:
– jumping from a moving vehicle,
– remaining on external parts of the vehicle (steps, bumpers, etc.) while it is moving.
8.3. During stops along the route, the Participants must exercise caution in areas with uneven ground, rocks, slopes, water, etc., and must comply with the instructions of the escorts.
9. Participation fees and method of payment
9.1. Participation in the Programs by persons who are not members of the Club is subject to the payment of a participation fee for the sports program (hereinafter: the “Fee”).
9.2. The amount of the Fee:
– is determined by the Board of Directors on the basis of the actual expenses (lease/charter of yacht and jeep, fuel, snacks/food and other direct costs),
– may vary depending on the type of Program, season, duration and other objective factors.
9.3. The Fees do not constitute annual membership subscriptions and do not confer membership status of the Club on the Participant.
9.4. Payment of the Fee may be made:
(a) In cash, to an authorized representative of the Club, with mandatory issuance of a receipt/accounting document and subsequent deposit of the amount into the official bank account of the Club;
(b) By bank transfer to the official bank account of the Club, with a clear indication in the “Reason for payment” field such as:
“Participation fee for sports program (date, program title)”.
9.5. The Treasurer of the Club keeps a separate register of all receipts related to the Programs, in which the date, type of Program, details of the Participants and the method of payment are recorded.
10. Cancellation, postponement and refund of Fees
10.1. The Club has the right to cancel or postpone a Program in the following indicative cases:
– adverse weather conditions,
– technical failures of the vessels or vehicles,
– insufficient number of Participants (minimum number to be determined by the Club),
– any other circumstance that makes the implementation of the Program unsafe or impossible (force majeure).
10.2. In the event of cancellation of a Program by the Club before it starts, the Participant is offered:
– either transfer of the participation to another date or another Program,
– or refund of the Fee (in whole or in part, if some services have already been provided or non-refundable expenses have been incurred, provided that the relevant conditions were announced in advance).
10.3. In the event of withdrawal by the Participant:
– if they give timely notice (within deadlines specified by the Club in the announcement or confirmation of participation), the terms of refund of the Fee are determined by the specific terms of each Program,
– in the case of late notice or unjustified non-attendance, the Fee may not be refunded.
10.4. In the event of early termination of participation in the Program on the Participant’s own initiative, as a rule no refund of the Fee is provided, unless there is a sudden deterioration in health or another exceptional event, in which case any refund is at the discretion of the Club.
10.5. The refund terms and any deductions are interpreted and applied in accordance with the applicable consumer protection legislation and other relevant provisions.
11. Liability and insurance
11.1. The Club and the persons in charge are obliged to act in good faith, to comply with safety rules and to exercise due care in the organization and conduct of the Programs.
11.2. The Participants acknowledge that the Programs involve objective natural and technical risks (marine environment, weather conditions, terrain morphology, etc.) and that they take part voluntarily.
11.3. To the extent permitted by the applicable legislation, the Club is not liable for:
– injuries or damages resulting from gross breach of the instructions and safety rules or from obvious carelessness of the Participant,
– damages caused by the Participant to third parties or to the property of third parties.
11.4. The possible existence of group or individual personal accident insurance is announced separately to the Participants. In the absence of such insurance, the Participant may take out an individual insurance policy at their own expense.
12. Personal data and photography/video recording
12.1. The processing of Participants’ personal data by the Club is carried out in accordance with the applicable data protection legislation and the internal policies of the Club.
12.2. Personal data are used exclusively for the purposes of organizing and conducting the Programs, fulfilling accounting/tax obligations, statistical monitoring and compliance with obligations towards public authorities.
12.3. The taking of photographic and/or audiovisual material during the Programs and its use in the Club’s information media is permitted only if the Participant (or their legal representative in the case of minors) has given the relevant consent.
13. Final provisions
13.1. This Regulation was approved by a decision of the Board of Directors of the Club and enters into force on the date of its approval.
13.2. Any amendment or supplement to this Regulation is approved by the Board of Directors and is communicated to the Participants through the Club’s official communication channels and/or other appropriate means.
13.3. Participation in a Program and/or signing the “Declaration of participation in a sports program” implies that the Participant has taken note of this Regulation and fully accepts its terms.
